MangaFuru Terms of Use

These Terms of Use (the "Terms") form a legally binding agreement between you and the MangaFuru Team (the "Team," "we," or "us") governing your use of the MangaFuru application and its related website. The Team is a small independent team / individual developer and is not a registered company.

By downloading, installing, accessing, or using the MangaFuru application or website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install or use the service.

You represent and warrant that you have full legal capacity to enter into these Terms. If you are below the age of legal majority in your place of residence, you may use the service only with the consent and supervision of your legal guardian. You further represent that your use of the service and of any source you configure is not prohibited by law in your place of residence.

For the purposes of these Terms, the following terms have the meanings set out below:

• "App" means the MangaFuru iOS application, including all of its versions, updates, and components.
• "Site" means the MangaFuru website hosted at https://mangafuru.github.io and related public project pages.
• "Sources" means the third-party extensions, remote services, or local services on your own device or network that you add, install, or enable, and through which the App browses, searches, opens, and reads content.
• "Repositories" means the lists or bundles of sources that you add and from which you may install or enable individual sources.
• "Content" means the manga, images, text, files, covers, chapters, metadata, and other materials that may be retrieved or displayed through the sources you configure. The Team does not own, host, or control such content.
• "Submissions" means any material you actively send to the Team or through a public channel, including issue reports, screenshots, diagnostic snippets, feedback, or other communications.

MangaFuru is a local-first manga reader combined with a source-configuration framework. The App's function is to let you add repositories, install and enable sources, and then browse, search, open, and read from the sources you have configured.

The Team does not operate a manga hosting, sales, or distribution platform or provide an official manga catalog or recommended-source list. Local import, indexing, downloads, and caches process content you add; they do not mean that the Team provides or licenses that content. The licence provided in the App covers only the App software itself; the Team grants you no right, title, licence, or permission of any kind in or to any content, source, or third-party material, and confers no authority to access any content you are not independently and lawfully entitled to access.

The "Local source" built into the App is a content-neutral mechanism only, for you to import or read files you already control on your own device or network. It provides no manga catalog or recommended sources; the App can create local indexes for files you import.

All sources, files, accounts, credentials, and access rights are configured and controlled by you. The App connects to a source to retrieve content only after you have actively configured that source, and only as you direct it to. The Team does not endorse, warrant, or control the existence, availability, legality, accuracy, or security of any source or its content.

Subject to your compliance with these Terms (and in particular the acceptable use rules in Section 5), the Team grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to install and use the App on a device you own or control, solely for your personal, non-commercial, and lawful use.

For the avoidance of doubt, this licence covers only the App software itself. It grants you no right, title, licence, or permission of any kind in or to any content, source, or third-party material, and confers no authority to access any content you are not independently and lawfully entitled to access. All of your use of the App must comply with Section 5 of these Terms and must be lawful.

The App licence is governed by Apple's Standard End User Licence Agreement (EULA), unless the App Store expressly provides an applicable custom EULA. These website Terms supplement the applicable EULA with MangaFuru service, content-use, and purchase information; they do not replace it. In a conflict on matters governed by the applicable Apple EULA, that EULA controls. Mandatory consumer rights under applicable law remain unaffected.

With respect to Apple, the parties acknowledge that: (a) these Terms are concluded between you and the Team only, and not with Apple, and the Team (not Apple) is responsible for the App and its content; (b) Apple has no obligation to furnish any maintenance and support services with respect to the App, and the Team is solely responsible for any such maintenance and support; (c) to the extent applicable, in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you, and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App; (d) the Team, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar law; and (e) the Team, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights.

The parties acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Export control and sanctions compliance: You represent and warrant that you are not located in any country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as "terrorist-supporting," and that you are not listed on any U.S. Government list of prohibited or restricted parties. You further agree to comply with all applicable export-control and sanctions laws in using the App.

You may not resell, sublease, lend, sublicense, or distribute the App, use it for commercial purposes, or remove or alter any proprietary notices, without the Team's prior written consent. All rights not expressly granted under this licence are reserved to the Team and its licensors.

MangaFuru is free to download and offers optional Premium features. Premium is currently a one-time, non-consumable in-app purchase, not an auto-renewing subscription, and has no recurring charge. The price, included features, and promotional conditions are those shown in the App and Apple's purchase confirmation at the time of purchase.

Apple handles purchases and payments. After reinstalling or moving to a compatible device, use the Apple account used for the original purchase and the App's Restore Purchases action to recover purchased entitlements, subject to Apple's transaction verification. A purchase includes no manga content, third-party source subscription, or content licence and does not guarantee continued availability of third-party sources.

You can request a refund through Apple's Report a Problem service, subject to Apple's process and applicable local law. You may also contact the Team for help with purchase or restoration issues. These Terms do not limit statutory refund rights, remedies for defects, or other mandatory consumer rights.

You are solely responsible for how you use the service and for any repositories, sources, and content you configure, install, enable, or access. You agree to use the service only in a lawful manner and in accordance with these Terms.

• You must comply with all applicable laws and with the terms and policies of each source and service you configure.
• You represent and warrant that you have the lawful right or authorization to access, configure, or open any source and content you use.
• You must not use the service to access, store, or read content that you do not have a lawful right to access, including content made available without the rights holder's authorization; you are responsible for verifying and confirming your rights in each source and in each item of content, and you assume all liability for doing so.
• You must not use the service to infringe the intellectual property, privacy, or other rights of any person.
• You must not use the service to bypass or circumvent any paywall, login mechanism, region lock, digital rights management, or other access control.
• You must not share, resell, or improperly make available account credentials, tokens, or access rights.
• You must not post passwords, private tokens, full cookies, paid content, personal data, or other secrets in any public report or diagnostic material.
• You must not use the service for any unlawful, fraudulent, infringing, or harmful purpose, or to interfere with or disrupt the service or any source.

You understand that content accessed through the sources you configure may include mature or age-restricted material. You are responsible for ensuring that such content is appropriate and lawful for your age and your jurisdiction; where the user is a minor, their legal guardian is responsible for supervising that minor's use and the sources they configure.

The sources, source services, and local services you configure are provided and operated by third parties or by you, and are outside the Team's control. Such sources and services are subject to their own terms and privacy policies, which you should review and comply with.

The Team makes no endorsement, warranty, or representation as to the availability, content, quality, legality, accuracy, security, or continued operation of any source or service. Any source, host, file format, login mechanism, or service may change, break, or become unavailable at any time, and the Team is not responsible for this.

You understand and agree that you use any third-party or self-hosted source and service at your own risk. The Team is not liable for any damage, loss, or dispute arising from such sources or services or their content.

If you submit issue reports, diagnostic material, screenshots, feedback, or other content to the Team, you grant the Team a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, store, adapt, and process that submission for the purpose of reproducing, diagnosing, fixing, maintaining, and improving the service.

You represent and warrant that you have the right to share what you submit, and that your submission does not contain confidential information you are not permitted to disclose, including passwords, private tokens, full cookies, paid content, personal data, or other secrets belonging to others.

Issue reports are handled through GitHub Issues (https://github.com/MangaFuru/MangaFuru/issues). Please note that public submissions are visible to others and may be indexed by search engines. Do not include in a public submission any information you do not wish to be made public.

The "MangaFuru" name, logos, trademarks, App, Site, and all related software, designs, and materials are owned by the Team or its licensors and are protected by intellectual property laws. Except for the limited licence expressly granted in these Terms, no such rights are transferred or granted to you.

You may not use the "MangaFuru" name or logos without the Team's prior written consent, or in any way likely to cause confusion or to suggest affiliation or endorsement.

All content obtained through sources and all third-party materials remain the property of their respective rights holders. You must respect those third-party rights and use such content only to the extent you are legally entitled to do so.

The App includes certain third-party components released under open-source licences; the applicable copyright notices, full licence texts, and (where applicable) how to obtain the corresponding source are listed in the in-app “Settings > Licenses / Acknowledgements” screen.

The Team does not solicit, encourage, or induce infringement, and will not knowingly facilitate it. Because the Team does not host, store, or distribute any manga content, any copyright or other rights complaint about content obtained through a source should, as a rule, be directed to the source or host that provides or hosts that content, as only that party is able to remove or address it.

For material the Team actually controls — that is, material on the Site, in the issue tracker, and any material the Team publishes — the Team provides a good-faith notice channel. If you believe in good faith that such material infringes your rights, you may contact us at gomanga.support@gmail.com. On credible notice, the Team will take reasonable action with respect to the surfaces it controls (including the Site, the issue tracker, and any Team-published material), including disabling or removing the material where appropriate.

Your notice should provide reasonable and sufficient information to enable us to identify and evaluate the complaint, including: identification and location of the allegedly infringing material, your contact details, a description of your rights, and a statement of your good-faith belief that the use is unauthorized. The Team will review properly submitted complaints in good faith within a reasonable time.

Repeat infringers and abuse: The Team reserves the right, in appropriate circumstances and to the extent permitted by applicable law, to terminate the access of users who use the App to infringe.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TEAM EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. The Team does not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

The Team makes no guarantee as to the continued operation or availability of any source, host, file format, login mechanism, or service. Any content obtained through a third-party or self-hosted source is obtained at your own discretion and risk. Nothing in these disclaimers affects any mandatory warranties or rights granted by applicable law that cannot be excluded, and nothing excludes or limits liability for death or personal injury, fraud or fraudulent misrepresentation, gross negligence or willful misconduct, or any other liability that cannot be excluded under applicable law.

All exclusions and limitations in this section are subject to the mandatory-liability reservation set out in the final paragraph of this section. Nothing in these Terms excludes or limits the Team's liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or willful misconduct; or (d) any other liability that cannot be excluded or limited under applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND SUBJECT TO THE RESERVATION ABOVE, THE TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR USE, arising out of or relating to your use of or inability to use the service or to any source or content you configure, regardless of the legal theory and whether or not the Team has been advised of the possibility of such damages.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND SUBJECT TO THE RESERVATION ABOVE, THE TEAM'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT IN ANY EVENT EXCEED THE GREATER OF: (a) THE AMOUNT YOU ACTUALLY PAID THE TEAM FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (b) WHERE PERMITTED, TEN (10) US DOLLARS (US$10) OR ITS EQUIVALENT. The App is free to download with optional in-app purchases; paragraph (a) includes amounts paid through Apple for the App or its premium features, and is zero for users who have made no purchase.

Some jurisdictions do not allow the exclusion or limitation of certain damages or the exclusion of certain mandatory consumer rights. In those cases, the above exclusions and limitations apply only to the maximum extent permitted by that applicable law, and nothing in this section affects rights you have under the mandatory consumer-protection law of your place of residence that cannot be excluded.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Team and its developers, contributors, and representatives from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• your use or misuse of the service;
• your breach of these Terms or of any applicable law;
• your configuration, access, or use of any source, service, or content, including any unauthorized or unlawful access;
• your infringement of the intellectual property, privacy, or other rights of any third party; or
• any of your Submissions.

The Team reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with the Team in that event.

These Terms take effect when you first access or use the service and continue while you use it.

You may terminate these Terms at any time by ceasing to use the service and removing the App. To the extent permitted by applicable law, the Team may suspend or terminate your right to use the service at any time, without prior notice, if you breach these Terms or to protect the service, the Team, or others.

On termination, provisions that by their nature should survive — including, without limitation, intellectual property, disclaimers, limitation of liability, indemnification, governing law, and interpretation — continue in effect. Termination does not affect local data on your device; whether that data remains is within your control.

The Team may update or modify these Terms from time to time to reflect changes to the service, legal requirements, or operational considerations. The revised version will be posted together with its effective date.

For material changes, the Team will provide notice by reasonable means, such as a notice on the Site or within the App. Your continued use of the service after the changes take effect constitutes your acceptance of the revised Terms, but does not replace any separate consent required by applicable law. If you do not agree to the revised Terms, stop using the service.

The Team prefers to resolve disputes amicably. If you have any concern about the service or these Terms, please first contact us at gomanga.support@gmail.com, and the parties shall, in good faith, seek an informal resolution within a reasonable period before pursuing any formal process.

These Terms do not designate the governing law or courts of any specific country or state. To the extent permitted by law, the relationship between the parties is governed by general, broadly enforceable legal principles. However, nothing in these Terms deprives you of the protections of the mandatory consumer-protection law of your place of residence; such mandatory law prevails to the extent it applies and entitles you to bring proceedings there.

To the extent permitted by applicable law, any claim shall be brought in your individual capacity, and not as a plaintiff or class member in any class or representative action.

If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with the applicable Apple EULA and the MangaFuru Privacy Policy, constitute the entire agreement between you and the Team regarding the service and supersede all prior oral or written communications and agreements on the same subject. The Team's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

You may not assign or transfer any of your rights or obligations under these Terms without the Team's prior written consent. Any assignment in violation of this provision is void.

The Team may freely assign or transfer its rights and obligations under these Terms to any successor or assignee, including in connection with a merger, acquisition, reorganization, or transfer of all or part of its assets, without further notice.

These Terms are provided in Traditional Chinese and English. The Traditional Chinese version is the controlling and authoritative text; the English version is a convenience translation.

In the event of any divergence, inconsistency, or dispute over interpretation between the Traditional Chinese and English versions, the Traditional Chinese version prevails.
